Consistency Accountability Statements

Under sections 11, 12 and 14 of the Regulatory Standards Act 2025, Government bills, Government amendments and secondary legislation must be accompanied by:

  • A Consistency Accountability Statement (CAS), which confirms that the responsible agency has assessed the legislation against the principles of responsible regulation in section 9, and summarises any inconsistencies with the principles
  • A Statement of Reasons from the responsible Minister or other maker of the legislation that briefly explains the reasons for any inconsistencies.

Cabinet Office Circular CO (26) 2 also requires responsible agencies subject to Cabinet direction to publish a Summary of underpinning analysis that supports the CAS.

Over time, agencies are also expected to review existing primary (and some secondary) legislation and publish the review documents.
