Tēnei tūranga – About the role

The Insolvency Examiner is part of the Central Insolvency Operations team that provides a high quality service dealing with applications for insolvency and case administration of insolvency cases and supports the Trust Accounting functions. The role also provides case administration support for low complexity criminal proceeds cases as required.

Key relationships include the broader Insolvency and Operations Support team, and externally with representatives of the courts, creditors and debtors.

Takohanga tuhinga o mua – Key accountabilities and deliverables

Responsibilities of this position are expected to change over time as the Ministry responds to changing needs. The incumbent will need the flexibility to adapt and develop as the environment evolves.

Critical areas of success

  • Analyse insolvency applications and examine case circumstances to verify the applicant meets the entry criteria
  • Create insolvency cases, and criminal proceeds cases should there be a requirement to provide support
  • Provide centralised file management and trust accounting services
  • Ensure efficient examining and processing of insolvency applications and court notices in accordance with relevant legislation, policies, procedures and priorities
  • Make improvements in ITS operational procedures, manuals, Best Practice Modules
  • Other members of the team are supported in their work and a strong contribution is made to the overall team workflows.
  • Ideas and experiences are shared amongst the team.

Debtor application and court notification processing

  • Ensures debtor applications and court notifications are correctly examined, processed and administered in accordance with ITS standards of quality and timeliness
  • Data input is complete and accurate
  • Recommendations for decisions are made in accordance with the legal and regulatory requirements considering the intent of the law, the teams’ strategic outcomes and the overall compliance strategy.
  • ITS SSP and Business Objectives relating to quality and timeliness are met and ITS policies and practices are adhered to.
  • Appropriate advertisements are correctly phrased and despatched as required by legislation and policies.
  • Judgement and common sense is exercised when classifying new estates.

Efficient operation of the OA’s Trust Accounts

  • Funds received are banked in accordance with audit requirements and ITS policies
  • Distributions and payments made from the trust account have been accurately calculated
  • Debtor and Creditor bank details are obtained and captured in the appropriate client contacts

Wellbeing, health & safety

  • Displays commitment through actively supporting all safety and wellbeing initiatives.
  • Ensures own and others safety at all times.
  • Complies with relevant safety and wellbeing policies, procedures, safe systems of work and event reporting.
  • Reports all incidents/accidents, including near misses in a timely fashion.
  • Is involved in health and safety through participation and consultation.
