Tēnei tūranga – About the role

The Investigator is a team member position in MBIE. The Investigator contributes to the operation of Te Whakatairanga Service Delivery (TWSD).

The Immigration Compliance and Investigations (ICI) branch within TWSD is responsible for managing the delivery of compliance, immigration investigation, and prosecution activities across the Northern, Central and Southern Regions. 
The Investigator will bring their criminal investigation skills, business understanding and perspective to work in partnership with their manager and other staff.

The Investigator is responsible for investigating Immigration fraud and the most serious of immigration offending, such as trafficking in persons, migrant exploitation and transnational organised crime.

Assistance is also provided to partner agencies in the investigation and prosecution of serious criminal offending that has an immigration component.

The Investigator is also responsible for ensuring quality and consistency of advice and practices in relation to their contribution to the team’s work.

Skills and experience

• Experience in planning and undertaking complex criminal investigations and prosecutions, in a team environment.
• The ability to support vulnerable complainants through the investigation and prosecution process.
• Sound understanding and application of NZ legislation in investigation and prosecution processes e.g., Criminal Procedures Act, Rules of Evidence, Bill of Rights, Official Information & Privacy Acts etc.
• Demonstrated planning and organising skills including the ability to maintain a high level of performance when under pressure.
• A demonstrated knowledge and application of modern investigation techniques including the use of IT software e.g., computer forensics.
• Experience managing risk, sensitive issues, and confidentiality in an enforcement area.
• Experience in delivering high quality files and reports within prescribed timeframes or other constraints.
• A demonstrated ability to develop and maintain positive working relationships at any level.
• Excellent communication skills.
• Proven ability to develop trust and credibility with managers and staff.
• An understanding of MBIE and where the team fits in delivering outcomes for the Ministry is desirable.
• Must be a NZ citizen or hold a permanent residence class visa.
• The ability to gain and maintain a national security clearance as required.
• Police vetting as required.

Qualifications

Tertiary qualification, preferably in law enforcement or related field and /or relevant experience in criminal investigation and prosecution related work.

Indicators of success

The Investigator will contribute to the day-to-day work of the team which will include:

• Using criminal investigative knowledge and experience to assist in the development of an initial investigative strategy for each case, with specific reference to identifying and securing relevant evidence, and then progress each investigation – adapting the strategy as information is received and analysed.
• Working closely with national investigation teams and managers to execute the investigation strategy and achieve the most appropriate investigative outcome on every case.
• Leading interviews, reporting on investigation and prosecution progress, and providing input to relevant reports › Preparing prosecution files and liaising with MBIE Legal Services and the Crown Prosecutor.
• Prepare, assist, oversee complex prosecution files to the highest standards required, giving evidence objectively and professionally in court, and assisting with the preparation and management of vulnerable complainants, witnesses and exhibits as and when required.
• Accountability for the quality of work delivered, by ensuring quality assurance and controls are defined and applied from the outset of an investigation.
• Delivery of investigation services, products and programmes that actively support and contribute to the achievement of the Ministry’s outcomes and that deliver to the needs of internal and external stakeholders.

• Participates as an active team member and contributes knowledge and expertise needed to achieve MBIE’s outcomes.
• Develops effective working relationships with other MBIE managers and staff in order to transfer knowledge and learning from the team to the wider organisation.
• Builds and maintains effective relationships and partnerships with internal and external stakeholders, as necessary, in order to identify and share best practice information and to promote the Ministry, its products and services.
