Chartered Professional Engineers Council – Member

On behalf of the Minister Building and Construction, the Ministry is seeking candidates who wish to be considered for appointment as member of the Chartered Professional Engineers Council.

About the Board

The Chartered Professional Engineers Council (the Council) is a statutory body established under the Chartered Professional Engineers Act 2002 (the Act). The Council’s role includes reviewing proposed changes to rules, hearing appeals from decisions of the Registration Authority in relation to registration and complaints, and reviewing and reporting to the Minister on the performance of the Registration Authority. 

Functions

The Council’s statutory duties include:

  • reviewing and approving rules containing CPEng standards
  • considering appeals against the Registration Authority decisions, including decisions not to place engineers on the Register, and on disciplinary matters. The Registration Authority is Engineering New Zealand
  • reviewing and reporting to the Minister on the performance of the Registration Authority and the Council in exercising their respective functions and powers under the Act.

Collective and individual duties

The Act sets out the provisions for the governance, reporting and accountability arrangements of the Council.

The collective duties of members are to ensure that the Council acts consistently with its objectives, functions, Statement of Performance Expectations and Output Agreements and that the Board’s functions are performed efficiently, effectively and in a manner consistent with the spirit of service to the public, and in a financially responsible manner.

The individual duties of members are:

  • to comply with their letter of appointment
  • to bring an objective and fair approach to disciplinary and registration related hearings
  • to be collaborative and an effective communicator, and be willing and available to devote time and energy to the role
  • to act with honesty and integrity, in good faith, with reasonable care, diligence and skills
  • not to disclose or make use of information that otherwise would not be available to them.

Membership of the Board

Section 49 of the Chartered Professional Engineers of New Zealand Act 2002 states that the Council's Board must have at least 6, but no more than 8, members appointed by the Minister.

Time commitment and remuneration

Fees and allowances determined by the Minister are in accordance with the Cabinet Fees Framework for the classification and remuneration of members of statutory and other bodies. Currently the daily fees are set at $395.00 for members.

The Council currently meets four times per year. Typically, the expectation is that members will spend up to ten to fifteen days per year on Council business, depending on appeal workload.

Person specifications

Specific skills required

Two candidates are sought who are Chartered Professional Engineers or have equivalent New Zealand experience.

Additional skills, experience and attributes required

Ideally candidates will have one or more of the following:

  • an appreciation of the responsibilities of the Council
  • applicable legal experience / familiarity to inform the appeals process
  • governance experience
  • the ability to work effectively in a collegial decision-making environment
  • commitment and integrity
  • effective communications skills
  • understanding of statutory responsibilities and government processes, for example accountability and conflict of interest
  • understanding of the role of engineers within society.

Anyone who is a member of the governing body of the Registration Authority, or an employee of the Registration Authority is excluded from consideration for the Chartered Professional Engineers Council.

Disclosure of interest

Before a person is appointed as a member of the Council, they must disclose, in an Expression of Interest form, the nature and extent (including monetary value, if quantifiable) of all interests that the person has at that time, or is likely to have, in matters relating to the Council.

This enables the responsible Minister to know the relevant interest and any conflict that a person may have in relation to appointment. The information is used to assess whether a candidate would be able to contribute effectively to the Council’s affairs, and where conflicts are identified, to ensure that these can be managed appropriately.
