MBIE is seeking feedback on an exposure draft of the Incorporated Societies Regulations 2023 and initial fees to be charged under the new regime.

Consultation on exposure draft of the Incorporated Societies Regulations 2023

We are seeking feedback on an exposure draft of the regulations and a proposal on initial fees under the Incorporated Societies Act 2022 (the 2022 Act). This proposes to roll over the current registration and restoration fees under the Incorporated Societies Act 1908 into the 2022 Act to cover the period until a full fees and levies review across all registers by the Companies Office is complete.

Background

The 2022 Act was passed in April 2022 and will enter fully into force in October 2023. However, in order to function as intended, it must first be supplemented by regulations.

These regulations determine some of the details of the new regime, such as how societies apply for incorporation or reregistration, and matters relating to the administration of societies.

A discussion document seeking public feedback on the proposed regulations opened for consultation on 11 October 2022 and closed on 22 November 2022.

In May 2023, Cabinet made policy decisions on the new regulations, which we are now consulting on an exposure draft of:
