New Zealand Grocery Code of Conduct Consultation paper

This consultation paper seeks feedback on the options for content of a Code. The paper provides a preliminary analysis of different options, including an assessment of each option against relevant criteria. The criteria, which are discussed below, will be used to identify the preferred options that are most likely to achieve the desired objective. Feedback from submitters will help MBIE to improve and finalise the preliminary analysis in this paper. The paper functions as an interim Regulatory Impact Analysis by weighing up the different policy options.

Dispute resolution best practice framework

The framework consists of five best practice principles, nine standards, 35 capability areas (what schemes should ‘do’ and ‘have’ to deliver best practice dispute resolution) and an assessment tool (to help schemes assess how well they meet best practice). The Framework is designed to help schemes identify what is working well, areas for improvement and what to strive for.

Liability outcomes in the building sector

This report looked at liability costs imposed on BCAs in negligence cases, including what proportion of building consents resulted in a dispute, how often BCAs are the ‘last party standing’, and the total amount of damages arising from building defect cases over the last 10 years.
