Tēnei tūranga – About the role

The primary focus of the Determinations team is to support the Chief Executive to exercise their powers to make determinations under the Building Act. Determinations are important aspects of the Building Act as they provide clarity on the operation of our performance based regulatory regime as well as providing a mechanism for participants in the sector to resolve disputes.

The Manager Determinations is a leadership and management position that reports to the Head of Building System Delivery & Assurance and leads a team of people leaders and technical experts to ensure the Determinations team can effectively deliver its regulatory functions with a view to continuously improving. The Determinations function is a quasi-judicial Tribunal.

The role is responsible for setting the strategic direction and work programme of the determinations function, ensuring effective and efficient delivery of determinations decisions and ensuring the team’s capacity, skillsets and resources are best applied to deliver determinations services consistent with relevant statutes and best practice standards.

As part of the Building System Delivery & Assurance Leadership Team, the Manager Determinations is also expected to contribute to the leadership of the wider building system.

Personal specifications

  • Experience in strategic direction setting together with strategic and operational management experience at senior level.
  • Experience leading a quasi-judicial tribunal or Tribunal function.
  • Ability to understand, use and explain the building regulatory framework, in particular in relation to the responsibilities of the Determinations team under the Building Act.
  • Good understanding of the issues facing the building and construction sector.
  • Experienced in understanding and analysing complex information and identifying key issues.
  • Ability to work in a demanding and complex environment with statutory timeframes.
  • Advanced decision making and problem solving skills.
  • Proven ability to lead, develop and manage a team.
  • Experienced at developing and delivering a work programme, including enabling tools and processes.
  • Experienced in communication of complex information through written documents.
  • Able to communicate and persuade using a range of oral, written and visual mediums in diverse situations.
  • Demonstrated experience in developing and maintaining an environment focused on continuous improvement to enhance organisational and regulatory performance.
  • Ability to quickly identify, establish and build strong working relationships within MBIE and across the sector.
  • Proven ability to develop trust and credibility with senior managers and stakeholders.
  • Excellent change leadership, communication and coaching skills to embed a culture of excellence in the team.
  • Strong ability to coach and mentor others by sharing their own experience and helping to challenge.
  • Knowledge of public sector requirements, processes and Government decision-making and operating procedures.
  • Excellent communication, negotiating and influencing skills.

Qualifications

  • A tertiary qualification in a relevant field, or extensive and comparable relevant experience.

Critical areas of success

  • Provide support to the team and the function through strategic direction setting, the use of sound improvement processes and solutions and supporting services.
  • Responsible for strategic direction setting for the Determinations function.
  • Responsible for the effective and efficient delivery of Determinations statutory decisions.
  • Works collaboratively as part of the Building System Delivery & Assurance leadership team to help drive change and work together to lift the overall performance and culture of the team.
  • Leads in developing and implementing a framework, approach and processes for Determinations cases and decisions.
  • Ensures team members carry out Determinations functions to a high standard and in accordance with relevant statutes and agreed processes and procedures.
  • Responsible for all planning, monitoring and other management functions for the Determinations team.
  • Takes a leadership position to drive desired outcomes, especially in relation to the regulatory objectives of the determinations function.
  • Partners with the Head of Building System Delivery & Assurance and wider Building System Delivery & Assurance Leadership Team to develop, articulate and give effect to the team’s strategy and other key priority work programmes.
  • Applies strong intellectual capability and judgement to analyse large, complex issues and readily grasps and synthesises ideas, analysis and advice produced by others.
  • Is viewed as a trusted advisor and a recognised expert in case management and dispute resolution by senior leaders in MBIE and the wider State Sector.
  • Leads complex and ambiguous issues with significant sensitivity and risk, by providing authoritative and frank advice that recognises the choices and constraints, anticipates needs, predicts and plans for potentially controversial or sensitive issues.
  • Develop and enhance open and trusting relationships and strategic alliances with other Building Systems Managers to underpin successful service delivery and regulatory stewardship.
  • Develop and enhance key relationships across the sector.

  • Builds strategic alliances with key government and non-government representatives, including national and international stakeholders, to ensure MBIE’s views are influential in their decision-making.
