Commerce Act Fees review

The Commerce Act (Fees) Amendment Regulations 2017 were notified in the gazette on 24 August 2017, setting the new application fees payable to the Commerce Commission for clearances and authorisations.

The new fees are as follows:

Type of application

New fee (GST inclusive)

Clearance of collaborative activity (section 65A)


Clearance of merger (section 66)


Authorisation of merger (section 67)


Authorisation of restrictive trade practice (section 58)


A new refund mechanism is also introduced. If the application fee paid is more than the cost to the Commerce Commission of determining that application, the Commerce Commission must refund the excess.
