In September 2016, the government released a consultation document seeking public submissions on proposals to amend section 258 of the Patents Act 2013.

Section 258 sets out how divisional patent applications that are divided out of patent applications filed under the Patents Act 1953 are dealt with, where the divisional patent applications were filed after the entry into force of the Patents Act 2013. 

The consultation document identified potential problems with section 258, and set out possible amendments to deal with these problems.
