Government announces new measures to target unfair commercial practices

The Government has decided on new measures to better protect businesses and consumers from unfair commercial practices.

Two key measures are to:

  • Prohibit conduct that is ‘unconscionable’ – that is, serious misconduct that goes well beyond what is commercially necessary or appropriate
  • Extend the current protections against unfair contract terms in standard form consumer contracts to also apply to business contracts with a value below $250,000.

The Government plans on bringing these measures into effect by introducing a Fair Trading Amendment Bill by early next year.
