Government announces new measures to target unfair commercial practices
Published: 25 September 2019
The Government has decided on new measures to better protect businesses and consumers from unfair commercial practices.
Two key measures are to:
- Prohibit conduct that is ‘unconscionable’ – that is, serious misconduct that goes well beyond what is commercially necessary or appropriate
- Extend the current protections against unfair contract terms in standard form consumer contracts to also apply to business contracts with a value below $250,000.
The Government plans on bringing these measures into effect by introducing a Fair Trading Amendment Bill by early next year.
